Terms and Conditions
The terms of every wholesale order, written for businesses and in plain English. Where a quote or invoice agreed with you says something different, the quote or invoice wins for that order.
1. Who we are and what these terms cover
thedubaiabaya.com and the The Dubai Abaya name are operated by NasrCapital FZE LLC, trade licence 2621016509888 issued by Ajman Nuventures Centre (ANC) Free Zone, Government of Ajman, whose registered office is at CWS-2V-226418, 26th Floor, Amber Gem Tower, Ajman, United Arab Emirates (“we”, “us”). These terms apply to every quote we give and every order we accept, whether you contact us through this website, the enquiry basket, WhatsApp, email or in person. Using the website itself is also covered by section 15.
2. We sell to businesses only
We sell wholesale, to businesses buying to resell or to supply their own customers: boutiques, online shops, brands, distributors and organisations. By ordering you confirm that you are buying for a business. We do not sell single pieces or sell to the public. Nothing in these terms takes away rights that UAE law gives you and that cannot be excluded by agreement.
3. Quotes and orders
A quote lists the styles, fabrics, colours, sizes, quantities, prices, production time, shipping terms and how long the quote is valid. It is not a contract until you accept it and we receive your deposit.
For made-to-order, private-label and custom work, the spec sheet you approve (fabric, measurements, colours, labels, packing) is the reference for your order. Please check it: we make what it says, and faults are judged against it.
We may decline an order, for example if we cannot make it to the date you need. If we do, we refund anything you have paid in full.
4. Minimum orders and sample orders

5. Prices and payment
- Prices are in AED unless your quote says otherwise, and do not include shipping, import duty or taxes in your country unless your quote says so.
- UAE VAT is charged where it applies. Goods exported outside the UAE are normally zero-rated for VAT. Your invoice shows any VAT charged.
- A 50–60% deposit starts production. The balance is due before dispatch; we send photographs of your packed cartons and the packing list first. See payment terms.
- We accept card by payment link, bank transfer to the UAE account named on your invoice, and letters of credit by arrangement. Each side pays its own bank charges.
- We never ask for payment to a personal account or to a name that differs from the company on your invoice. If you receive such a request, call us on +971 50 506 1871 before paying.
Goods stay our property until they are paid for in full. We do not dispatch an order with a balance outstanding.
6. Production and delivery dates
Production times are counted in working days from the date your deposit clears and your spec sheet is approved. The windows on our lead times page, and the date in your quote, are our honest estimate, not a guarantee. If your order will be late, we tell you as soon as we know, with a new date. If the delay is our fault and runs more than 15 working days past the quoted date, you may cancel and we refund everything you have paid.
7. Changes and cancellations

8. Normal variation
Fabric is dyed in batches, so shades can differ slightly between dye lots and from colours on a screen. If colours must match across an order or a reorder, tell us before we cut and we will cut from one lot where possible. Measurements are made to the tolerances printed on your spec sheet. Differences within those tolerances, or small variations in handwork and embroidery, are not faults.
9. Private label, custom designs and artwork
- Your logos, labels, artwork and brand names remain yours. We use them only to make your orders, and never on anyone else’s.
- You confirm that you have the right to use everything you send us and that it does not infringe anyone else’s trademark, copyright or design. You are responsible if it does.
- Our catalogue designs, patterns and grading remain ours. A catalogue style made with your label is not exclusive to you.
- A design made from your own pattern or tech pack stays yours, and we will not make it for anyone else. Exclusivity on an adapted catalogue design is available only if agreed in writing on your quote.
- Private-label and custom orders are made to your specification and cannot be returned unless they are faulty.
10. Shipping, customs and risk
We quote FOB Dubai by default, or CIF to your port or DDP to your door when agreed on your quote. The Incoterm on your quote (Incoterms 2020) decides who pays what and when the risk in the goods passes to you. Under FOB, and for courier shipments we arrange for you, risk passes when we hand the cartons to the carrier. See shipping and landed cost.
Unless your quote is DDP, you are the importer: import duty, taxes, customs clearance and any fees in your country are yours to pay, and we are not responsible for delays at customs. We describe and value goods truthfully on customs documents and will not under-declare them.
Check every carton on arrival. Faulty, wrong, short or damaged goods must be reported within 7 days of delivery, as set out in our refund and returns policy. We help with any claim against the carrier for loss or damage in transit.
11. Our liability
If goods are faulty, our responsibility is to replace them, credit you or refund you as the refund policy sets out. Beyond that, our total liability for any order is limited to the price you paid for that order, and we are not liable for loss of profit, loss of business, or other indirect or consequential loss. Nothing in these terms limits liability that UAE law does not allow to be limited, including for fraud.
12. Events outside our control
We are not responsible for delays or failures caused by events we cannot reasonably control, such as natural disasters, epidemics, war, government action, port or airport closures, carrier failures, or interruptions to fabric supply. We will tell you promptly, keep you updated and do our best to limit the delay. If such an event delays your order by more than 60 days, either of us may cancel, and we refund anything you have paid for work not yet done.
13. Payment disputes
If something is wrong, talk to us first: most problems are solved within a day. Please do not raise a chargeback or payment dispute for goods you have received and not reported as faulty under the refund policy. If one is raised, we will provide the order, spec sheet, carton photographs and tracking to the payment provider.
14. Your data
We use your details to quote, make, ship and invoice your orders. How we handle them is in our privacy policy.
15. Using this website
The text, photographs, graphics and design of this website belong to us or are used under licence. You may share links to our pages, but you may not copy product photographs or text for your own listings without our written permission. Some photographs are illustrative stock images and are labelled as such. We keep the website accurate and current, but prices, stock and lead times are confirmed only in your quote.
16. Law and disputes
These terms and every order are governed by the laws of the United Arab Emirates as applied in the Emirate of Ajman, where NasrCapital FZE LLC is registered. We will always try to settle a disagreement by talking first. If we cannot, the courts of Ajman have jurisdiction.
If a part of these terms is found to be unenforceable, the rest still applies. We may update these terms; the version on this page on the day we accept your order is the one that applies to it.
